Terms of Service
These Terms of Service (“Terms”) govern your use of AreTheyUp — the website at aretheyup.dev, the console at console.aretheyup.dev, the iOS application distributed through the Apple App Store, and the Android application distributed through Google Play (collectively, the “Service”) — operated by OSD Consulting (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The short version. AreTheyUp is an uptime monitoring tool, not a guarantee. Only monitor infrastructure you own or are authorized to monitor. Pro subscriptions are billed by Apple or Google, auto-renew, and can be cancelled in your store settings. We work hard to detect outages and deliver alerts, but we cannot promise we will catch every outage or that every alert will arrive — do not rely on AreTheyUp as your only safety mechanism for critical systems.
1. The Service
AreTheyUp provides uptime monitoring with alerting: it periodically checks the HTTP/HTTPS endpoints, databases, and TCP services you configure, records status and latency, and notifies you through the channels you enable (mobile push, Telegram, email). It also provides dashboards, incident history, public status pages, and reports. We may add, change, or remove features over time; material reductions to paid features will be notified in advance.
If you downloaded the iOS app from the Apple App Store, Apple’s standard Licensed Application End User License Agreement also applies to the app itself.
2. Accounts
- You must provide accurate, current information and keep it up to date.
- You are responsible for keeping your credentials secure and for all activity under your account.
- You must be at least 13 years old (or 16 where applicable law requires) to use the Service. AreTheyUp is a developer tool and is not directed at children.
- One account per user. Workspace sharing is the supported way to collaborate.
- We may suspend or terminate accounts that breach these Terms (see section 8).
3. Plans, subscriptions & billing
The Service offers a Free tier and a paid subscription, AreTheyUp Pro:
- Price: $4.99 per month or $49.99 per year. Local prices may vary by region and currency; the exact price is always shown in the store at the time of purchase.
- Free trial: both plans include a 7-day free trial. The trial converts to a paid subscription unless you cancel before the trial ends.
- Auto-renewal: subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
- Billing & management: payment is handled entirely by the Apple App Store or Google Play. We never see your card details. Manage or cancel in your store settings (iOS: Settings → your name → Subscriptions; Android: Play Store → Payments & subscriptions).
- Refunds: refunds are handled by Apple and Google under their own store policies. We are not able to issue App Store or Play Store refunds ourselves.
- Price changes: if we change subscription prices, you will be notified in advance through the store and/or in-app, and the change will only apply at your next renewal. You can cancel before it takes effect.
What Pro includes
Unlimited services, 30-second check intervals, email alerts (in addition to push and Telegram), 90-day incident history, unlimited workspace members, and public status pages. The feature list may evolve; the current comparison is on the pricing page.
Enterprise plans (custom SLAs, invoice billing, SSO) are governed by a separate written agreement — contact us.
4. Acceptable use
You agree to:
- Monitor only endpoints and infrastructure that you own or are explicitly authorized to monitor.
- Not use the Service to harass, overload, or probe third-party infrastructure.
- Not abuse check frequency, circumvent plan limits, or interfere with the operation of the Service.
- Not resell, sublicense, or redistribute the Service without our written consent.
- Not reverse engineer the Service except to the extent permitted by applicable law.
- Use the Service only in compliance with applicable laws.
We may throttle, pause, or remove monitors — or suspend accounts — that violate this section.
5. Service disclaimer — no SLA
AreTheyUp is a monitoring tool, not a service-level agreement. We do not guarantee that every outage will be detected, that every alert will be delivered, or that checks will always be accurate. Alert delivery depends on third-party systems outside our control (Apple Push Notification service, Firebase Cloud Messaging, Telegram, email providers), and false positives and false negatives can occur.
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. Do not rely on AreTheyUp as your sole mechanism for protecting revenue-critical or safety-critical systems.
6. Limitation of liability
To the maximum extent permitted by applicable law:
- We are not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data — including losses arising from missed, delayed, or false alerts, or from downtime of the Service itself.
- Our total aggregate liability for any claim arising out of the Service is capped at the amounts you paid us in the 12 months preceding the claim.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, and mandatory consumer protections in your country of residence remain unaffected.
7. Intellectual property
The Service, its software, design, and branding belong to OSD Consulting. You retain all rights to the data and configurations you create; you grant us the license needed to process them solely to provide the Service, as described in our Privacy Policy.
8. Termination
You may stop using the Service and delete your account at any time (Settings → Account → Delete account, or see the Privacy Policy). Deleting your account does not automatically cancel a store subscription — cancel it in your store settings. We may suspend or terminate access for breach of these Terms, with notice where practicable. Sections 5–7 and 10 survive termination.
9. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date above reflects the latest version. Material changes will be announced in-app or by email at least 7 days before they take effect; continued use after the effective date constitutes acceptance.
10. Governing law & venue
These Terms are governed by the laws of Côte d’Ivoire. Any dispute that cannot be resolved amicably will be submitted to the competent courts of Abidjan, Côte d’Ivoire, without prejudice to mandatory consumer protections in your country of residence.
These Terms are available in English and French. In case of conflict between versions, the English version controls.
